By accessing or using CreatorDefense ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

CreatorDefense provides AI-powered content protection services, including but not limited to: automated content scanning, leak detection, and DMCA takedown notice generation for digital content creators.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for safeguarding your account credentials and for any activities or actions under your account.

4. Subscription and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date.

  • All fees are non-refundable except as required by law.
  • We reserve the right to change pricing with 30 days' notice.
  • Failed payments may result in suspension of your account.

5. Acceptable Use

You agree not to misuse the Service. This includes, but is not limited to:

  • Submitting false or fraudulent DMCA takedown requests.
  • Using the Service to infringe upon others' intellectual property rights.
  • Attempting to gain unauthorized access to the Service or its systems.
  • Using the Service for any unlawful purpose.

6. Intellectual Property

You retain all rights to the content you upload to the Service. By uploading content, you grant CreatorDefense a limited license to use that content solely for the purpose of providing the Service.

The Service itself, including its design, code, and branding, is the intellectual property of CreatorDefense and is protected by applicable laws.

7. DMCA Takedown Services

CreatorDefense assists in generating and sending DMCA takedown notices on your behalf. By using this feature, you represent and warrant that:

  • You are the copyright owner or authorized to act on behalf of the owner.
  • The information provided in takedown requests is accurate.
  • You understand that misrepresentation may result in legal liability.

8. Limitation of Liability

To the maximum extent permitted by law, CreatorDefense shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that all infringing content will be detected.

10. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may cancel your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
